- License Grant: Concordia Publishing House (“CPH”) grants Church (“Licensee”) the nonexclusive right to reproduce the “Liturgy Resources” (as such term is hereinafter defined) for use in the congregational life of the Licensee. Reproduction may be in the form of printing or projecting Liturgy Resources. In addition, Licensee is permitted to record worship services containing Liturgy Resources by either audio or audio-visual means to stream/podcast on Licensee’s website and/or social media site or distribute for one-time use to members of the Licensee’s church who are sick, elderly, or homebound on CD or DVD.
- Definition of “Liturgy Resources”: For purposes of this Agreement, “Liturgy Resources” shall mean the Liturgies, Rites, Blessings, Propers, Psalm tones, Canticles, and Collects found in the Pew Edition, Altar Book, and Agenda in the following hymnals published by CPH: Lutheran Service Book, Lutheran Worship, and The Lutheran Hymnal. Additional permission must be secured to use other worship resources copyrighted by CPH. This grant of license specifically does not include any liturgy resources found in Hymnal Supplement 98.
- License Fees: This Liturgy License will be automatically renewed upon the anniversary date of purchase. Licensee may cancel this license before the expiration of the then-current license period. License renewal fees are billed at the annual rate in effect at the time of the renewal. These rates are subject to change without notice.
- Restrictions: No material reproduced or recorded pursuant to this license may be sold or distributed for payment or donation of any kind, or in any manner disseminated via the internet (other than as part of its worship services streamed or podcasted on Licensee’s church website and/or social media sites) or outside the congregational membership in any manner. Licensee agrees that it will not alter the words or music of the portions of the Liturgy Resources that it uses.
- Copyright Notice: Licensee agrees that each reproduction of the Liturgy Resources will include a proper notice of copyright in the following form:
Liturgy (or the appropriate portion thereof) from [insert hymnal name] © xxxx Concordia Publishing House. Used by permission. License #xxxxx.
Copyright notices pertaining to Liturgy Resources shall be placed at the end of the printed or projected worship service.
- Term: The term of license takes effect upon payment of the annual license fee and remains in effect for one year. The License is subject to automatic renewal as set forth above, unless terminated as provided by this Agreement.
-
Termination: This License Agreement shall terminate: (1) in the event that Licensee fails to pay the License Fee in which case termination shall be automatic and shall occur on the expiration date; or (2) in the event that the Licensee fails to comply with the terms and conditions of this Agreement, in which case the termination shall be effective 30 days after receipt by Licensee of written notice of termination.
-
Other: In addition, this License Agreement: (1) cannot be assigned or transferred by Licensee without the approval of CPH; (2) is the exclusive agreement between Licensee and CPH concerning the Liturgy Resources; (3) is governed by the laws of the State of Missouri; and (4) may be modified at any time by CPH with or without notice.
